1. Introduction and Scope
These Terms and Conditions (“Terms”) govern your use of the website located at https://hotwaterspecair.com.au (the “Website”) and apply to all quotes, inquiries, purchases, installations, and supply agreements entered into with SPECIALISED HEATING & COOLING PTY LTD (“we”, “us”, “our”, or “Specair”).
By accessing our Website, submitting a quote request, or engaging our supply and installation services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our related policies.
2. Services and Products
- Supply and Installation: Specair supplies, sells, replaces, and installs residential and commercial energy-efficient hot water systems, specifically heat pump hot water systems (including brands such as NeoPower, Daikin, Haier, Hisense, and Panasonic).
- Decommissioning and Disposal: Where agreed, services include the decommissioning, disconnection, and removal of existing gas or electric storage water heaters.
- Plumbing and Electrical Work: All plumbing and electrical works are conducted by licensed tradespersons compliant with Victorian Building Authority (VBA) standards, Energy Safe Victoria (ESV) regulations, AS/NZS 3000 (Wiring Rules), AS/NZS 3500 (Plumbing and Drainage), and applicable NSW Fair Trading guidelines where services cross borders.
3. Quotations, Pricing, and Rebates
3.1 Advertised Pricing & Point-of-Sale Rebates
- Advertised promotional pricing (such as “270L From $990.00* Fully Installed” or “320L From $1,390.00* Fully Installed”) represents net pricing and is strictly contingent upon the assignment of all eligible government environmental rebates and incentives.
- Net prices account for eligible:
- Victorian Energy Upgrades (VEU) certificates / Victorian Energy Efficiency Certificates (VEECs);
- Solar Victoria Hot Water Rebates (subject to homeowner income and property eligibility);
- Commonwealth Small-scale Technology Certificates (STCs) under the Renewable Energy (Electricity) Act 2000 (Cth).
- Interstate/NSW Pricing: Advertised Victorian promotional packages do not automatically apply to New South Wales. NSW installations are subject to Energy Savings Scheme (ESS) and Peak Demand Reduction Scheme (PDRS) rules, with pricing confirmed on a case-by-case basis.
3.2 Customer Rebate Assignment Obligations
- By agreeing to our net quote, you agree to formally assign the rights to create and claim all applicable VEECs, STCs, or state incentives to Specialised Heating & Cooling Pty Ltd or its nominated accredited provider.
- You warrant that:
- You are the registered owner of the property (or have written authorization from the owner).
- The hot water system being replaced is an eligible inefficient gas or electric system that has not previously claimed duplicate rebates under the same scheme.
- All information provided regarding income eligibility (for means-tested Solar Victoria schemes) and identity verification is true and correct.
- Rebate Rejection or Ineligibility: If any government body (e.g., Solar Victoria, Essential Services Commission, Clean Energy Regulator) rejects or revokes your rebate claim due to false details, prior claims, property ineligibility, or missed deadlines outside our control, you remain liable to pay the full, unsubsidised price of the equipment and installation.
3.3 Site-Specific Variations
Standard advertised installation prices apply solely to standard back-to-back replacements located in identical positions with compliant existing pipework, switchboard capacity, and drainage. Additional charges apply for:
- Switchboard upgrades, circuit breaker installations, or safety switch (RCD) additions;
- Relocating pipework or running new copper runs exceeding standard lengths;
- Concrete slabs or structural plinths where stable ground is not present;
- Restricted or hazardous access requiring specialized equipment or additional labor.
4. Site Access and Installation Conditions
- Access: The customer must grant our technicians and contractors safe, unobstructed access to the installation area, switchboards, water mains, and drainage points on the agreed service date.
- Hazardous Materials: If asbestos, substandard wiring, corroded structural supports, or other hazardous materials are identified, works may be suspended immediately. Remediation will be required at the customer’s expense before work resumes.
- Approvals: Customers are responsible for obtaining any required Owners Corporation (body corporate) or municipal approvals prior to work commencing.
5. Australian Consumer Law (ACL) Guarantees & Warranties
5.1 Statutory Guarantees
Our goods and services come with guarantees that cannot be excluded under Schedule 2 of the Competition and Consumer Act 2010 (Cth) (the Australian Consumer Law). For major failures with the service, you are entitled to:
- Cancel your service contract with us; and
- A refund for the unused portion, or compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service.
5.2 Manufacturer Warranties
- Heat pump tanks, compressors, and electronic controllers carry separate warranties issued directly by their respective manufacturers (e.g., NeoPower, Daikin, Haier).
- Manufacturer warranties are contingent upon regular maintenance, correct operation within designated operating parameters (e.g., water quality, operating ambient temperature ranges between -7°C and 43°C), and installation by an accredited installer.
5.3 Workmanship Warranty
Specair provides a statutory workmanship warranty covering installation labor in accordance with the Building Act 1993 (Vic) and VBA compliance requirements. Compliance Certificates will be issued for all prescribed plumbing works exceeding statutory monetary thresholds.
6. Limitation of Liability
Except for non-excludable guarantees provided under the Australian Consumer Law:
- Specair is not liable for indirect, consequential, or economic losses, including loss of profits, water damage resulting from existing faulty client pipework, or auxiliary heating failures caused by general power outages.
- Our liability for breach of a condition or warranty implied by law that cannot be excluded is limited, at our discretion, to:
- Replacing the goods or supplying equivalent goods;
- Repairing the goods;
- Re-performing the installation services; or
- Refunding the amount paid for the affected goods or services.

9. Cancellations, Deposits, and Rescheduling
- Customer Cancellations: Where custom equipment has been ordered or site-specific preparations completed, cancellation fees reflecting our reasonable out-of-pocket expenses and restocking charges may apply.
- Cooling-Off Period: Unsolicited consumer agreements adhere to statutory 10-business-day cooling-off periods in accordance with the ACL.
- Rescheduling: We reserve the right to reschedule installations in the event of adverse weather conditions, extreme heat or storms posing health and safety risks under WorkSafe Victoria guidelines.
